ATC transfers terror case against Imran Khan to sessions court

The IHC ordered the removal of sections of the Anti-Terrorism Act (ATA) from the terrorism case.
The case was heard by Justice Raja Jawad Abbas Hassan.
In its order, the ATC has said that the accused is free and can approach the relevant forum for bail.
ISLAMABAD: The Anti-Terrorism Court on Tuesday transferred the terrorism case registered against PTI Chairman Imran Khan to the Sessions Court following the order of the Islamabad High Court (IHC). Anti-Terrorism Act Case to (ATA) section.
Khan was charged with terrorism after he threatened an additional sessions judge and capital police personnel while addressing supporters at a political rally of his party.
Justice Raja Jawad Abbas Hasan heard the case in the anti-terrorism court of Islamabad. PTI chief On his behalf, lawyer Babar Awan appeared in the court and read out the IHC order to remove the terrorism provisions from the case.
Awan requested that the case be transferred to the Sessions Court on the orders of the IHC.
Responding to Awan’s plea, the Anti-Terrorism Court judge said that no challan was filed for the removal proceedings and another plea for bail.
We have neither received the challan, nor the witness statement, or anything else, so what should we transfer?” asked the judge.
The judge said that the court had till now only the matter of bail and following the IHC order, it no longer had jurisdiction.
Babar replied that the court has other bail applications on September 27 but the court can order the rest. The judge asked Awan to resubmit the bail plea, while Babar said he would not withdraw the plea.
The court also sought the opinion of the Special Prosecutor Rizwan Abbasi and adjourned the hearing till his appearance. Following the adjournment, the court, following the IHC’s order, ordered Khan’s case to be transferred to session.
